THE ANNOTATED CODE OF MARYLAND TITLE 6 – ELECTRIC LAW OF MARYLAND INTRODUCTION AND PROPOSED CHANGES SINCE THE EARLY 1900S, OFFICIALS ACROSS THE STATE HAVE BEEN AWARE THAT THE USE OF ELECTRICITY COULD POSE POTENTIAL RISKS TO THE LIFE, SAFETY, HEALTH AND PROPERTY DAMAGE TO THE CITIZENS OF MARYLAND. LOCAL JURISDICTIONS (AT VARIOUS TIMES), ESTABLISHED ELECTRICAL ADMINISTRATIVE BOARDS TO REGULATE ELECTRICITY IN THEIR LOCAL AREAS. DUE TO ELECTRICITY’S RAPID GROWTH, INNOVATIVE CONCEPTS SUCH AS CHANGES IN GENERATION, ALTERNATIVE POWER SOURCES (SOLAR, WIND, FUEL CELLS, HYBRID DISTRIBUTION SYSTEMS, ETC.) AND THE COMPLEXITY OF INSTALLATIONS, VARIOUS SEGMENTS OF THE INDUSTRY (ADMINISTRATIVE OFFICIALS, CONTRACTORS, INSPECTORS AND BUSINESS ASSOCIATIONS), HELPED DRAFT AND PASS THE STATE ELECTRICAL LAW IN 1984. THIS EXISTING LAW NOW ESTABLISHES UNIFORM TESTING STANDARDS, QUALIFICATIONS AND PROCEDURES TO LICENSE AND REGULATE MASTER ELECTRICIANS STATEWIDE. IT SETS MINIMAL INSURANCE LIMITS WHICH BENEFITS EVERYONE AND ALLOWS BUSINESS OPPORTUNITIES TO FLOURISH ACROSS JURISDICTIONAL BOUNDARIES WITHOUT SELF-INTEREST BARRIERS. SINCE 1984, PERIODICALLY, ADJUSTMENTS HAVE BEEN MADE TO TITLE 6 TO ACCOMMODATE THE MANY CHANGES THAT HAVE OCCURRED IN THE ELECTRICAL INDUSTRY.

ALTHOUGH THE PRESENT SYSTEM HAS OPERATED SATISFACTORY FOR OVER 30 YEARS, IT’S FELT, ONCE AGAIN, BY THE INDUSTRY, THAT REFINEMENTS NEED TO BE MADE TO TITLE 6 IN ORDER TO BETTER PROTECT THE GENERAL PUBLIC AND ADD GREATER INTEGRITY TO THE ELECTRICAL INDUSTRY.THERE ARE ALSO CONCERNS ABOUT A TRADE WITH A GREAT NUMBER OF “GRAYING” OR RETIRING EXPERIENCED WORKERS, LEADERS AND OFFICIALS. THE INDUSTRY WANTS TO OFFER THE FOLLOWING PROPOSALS TO ENSURE THAT A SKILLED WORKFORCE IS RETAINED AND OFFER WAYS TO RECRUIT AND ENTICE FUTURE WORKERS TO BECOME PART OF A REWARDING AND CHALLENGING CAREER OR VOCATION AS THEY PROVIDE A VITAL SERVICE TO THEIR FELLOW CITIZENS. THEREFORE, JOURNEYPERSONS AND APPRENTICES SHOULD BE ADDED TO ELECTRICIANS THAT ARE LICENSED BY THE STATE ELECTRICAL BOARD, IN ADDITION TO CONTINUING EDUCATION (NOW REQUIRED OF MASTERS), ACTIVE JOURNEYPERSONS AND INSPECTORS WILL ALSO BE REQUIRED TO HAVE 10 HOURS OF CONTINUING EDUCATION, ADD DEFINITIONS TO DEFINE NECESSARY TERMS, ESTABLISH A NATIONAL STANDARD STATEWIDE ELECTRICAL CODE, ALIGN THE STATE BOARD TO HAVE AN ELECTRICAL INSPECTOR AS ONE OF ITS MEMBERS, ADD CERTAIN ENHANCEMENTS TO BECOME PARTS OF THE STATE LAW.

  1. CHANGE THE NAME OF TITLE 6 FROM  THE BOARD OF MASTER ELECTRICIANS TO THE STATE BOARD OF ELECTRICIANS. A. THIS CHANGE WILL ALLOW FOR 3 CLASSES OF STATE LICENSES: MASTER, JOURNEYPERSON AND APPRENTICE. B. ALL 3 CLASSES OF THOSE LICENSE (MASTER, JOURNEYPERSON AND APPRENTICE) WILL BE REQUIRED TO BE LICENSED BY THE STATE BOARD. (NOTE: THERE WILL BE AN EXCEPTION FOR THOSE COUNTIES THAT ALREADY LICENSE JOURNEYPERSONS.) C. ANY OTHER SPECIAL TYPE OF LICENSE SUCH AS LIMITED, RESTRICTED, SPECIALTIES, ETC. WILL BE HANDLED AT THE LOCAL LEVEL THROUGH THE RECIPROCITY SYSTEMS AND PROCEDURES ALREADY IN PLACE.

  2. ADD THE FOLLOWING DEFINITIONS TO 6-101 A. ACCREDITED ELECTRICAL EXAMINATION: ONLY EXAMINATION QUESTIONS AND THEIR ANSWERS FORMATTED AND PROPORTIONATELY SELECTED FROM THE BANK OF UNIFORM QUESTIONS AND GUIDELINES BASED ON ELECTRICAL THEORY AND THE NATIONAL ELECTRIC CODE (NEC). THOSE GUIDELINES, QUESTIONS AND ANSWERS WILL BE PROVIDED BY THE MARYLAND UNIFORM ELECTRICAL LICENSING EXAMINATION COMMITTEE (MUELEC) FOR STANDARDIZATION AND INTEGRITY OF TESTING.

B. APPRENTICE: UNLESS THE CONTEXT REQUIRES OTHERWISE, AN INDIVIDUAL LICENSED BY THE STATE BOARD TO ASSIST A MASTER OR JOURNEYPERSON PROVIDING ELECTRICAL SERVICES. C. JOURNEYPERSON: UNLESS THE CONTEXT REQUIRES OTHERWISE, AN INDIVIDUAL LICENSED BY THE STATE BOARD TO PROVIDE ELECTRICAL SERVICES UNDER THE CONTROL OF A MASTER ELECTRICIAN. (SEE THE NOTE FOR EXISTING FIVE COUNTIES AS IT APPLIES TO JOURNEYPERSON LICENSING ONLY.) D. MASTER: ALREADY DEFINED IN TITLE 6.

  1. ADD PARTS B SECTION TO 6-201 OF TITLE 6 THAT WILL  ESTABLISH A STATEWIDE ELECTRICAL CODE THAT MUST BE USED BY ALL JURISDICTIONS HAVING AUTHORITY. IT WILL READ AS FOLLOWS: THE MARYLAND STATEWIDE ELECTRICAL CODE WILL BE THE LATEST EDITION OF THE NATIONAL ELECTRICAL CODE (NEC) ADOPTED AND PROMULGATED BY THE NATIONAL FIRE PROTECTION ASSOCIATION (NFPA). THE STATE ELECTRICAL CODE WILL BECOME EFFECTIVE WHEN IT IS ADOPTED AND PROMULGATED BY THE STATE FIRE MARSHAL AS REQUIRED FOR LIFE AND BUILDING SAFETY. (SEE NFPA #1 AND #101 FOR ALL MARYLAND CITIZENS.) EXCEPTIONS WILL BE ALLOWED FOR LOCAL JURISDICTIONS AS NEEDED BY LOCAL ORDINANCES OR LAWS FOR SPECIAL ENVIRONMENTAL, SAFETY OR HEALTH CONDITIONS. LOCAL AUTHORITIES WILL BE ALLOWED TO ENFORCE THE STATE CODE AND THEIR EXCEPTIONS EARLIER, BUT NOT LATER THAN THE FIRE MARSHAL’S EFFECTIVE DATE. THOSE EXCEPTIONS SHALL BE IN WRITING, SUBMITTED TO THE STATE ELECTRICAL BOARD SO THAT AN UPDATED CENTRAL FILE WILL BE ON RECORD OF ALL LOCAL EXCEPTIONS. LOCAL AUTHORITIES SHALL BE REQUIRED TO NOTIFY ALL LICENSED OR REGISTERED APPLICANTS WHO ARE ISSUED PERMIT TO INSTALL ELECTRICAL SERVICES IN THAT LOCAL AREA AS TO THE EFFECTIVE ENFORCEMENTDATES AND THOSE EXCEPTIONS.

  2. ADD TO SECTIONS 6-201 OR 6-310  EXPAND THE CONTINUING EDUCATION REQUIREMENTS TO INCLUDE ACTIVE JOURNEYPERSONS AND ACTIVE ELECTRICAL INSPECTORS HOLDING LICENSES IN MARYLAND. THE 10 HOURS OF CONTINUING EDUCATION SHALL BE ENFORCED PRIOR TO THE RENEWAL OF THOSE ACTIVE LICENSE HOLDERS. INACTIVE LICENSE HOLDERS, WITH THE EXCEPTION OF ACTIVE ELECTRICAL INSPECTORS, SHALL NOT BE REQUIRED TO HAVE CONTINUING EDUCATION;  ALL INACTIVE STATE LICENSED MASTERS, JOURNEYPERSONS OR INSPECTORS SHALL MEET THE CONTINUING EDUCATION REQUIREMENTS (10 HOURS) PRIOR TO REACTIVATING THEIR LICENSE. PROOF OF THE 10 HOURS OF THE CONTINUING EDUCATION AT THE STATE LEVEL SHALL SATISFY OR SUPERSEDE ANY LOCAL REQUIREMENTS.

  3. ADD A SECTION THAT STATES  ONLY SKILLED, KNOWLEDGEABLE AND COMPETENT WORKERS ARE OVERSEEING ELECTRICAL INSTALLATIONS AND THAT AT LEAST ONE ACTIVE MASTER OR JOURNEYPERSON IS REQUIRED ON THE JOBSITES.

  4. ADD A SECTION THAT STATES  A PERSON MAY NOT EMPLOY ANY INDIVIDUAL TO PROVIDE OR ASSIST IN PROVIDING ELECTRICAL SERVICES UNLESS THAT INDIVIDUAL IS LICENSED BY THE STATE BOARD OR BY THOSE 5 COUNTIES NOTED.

  5. CHANGE WORDING IN SECTION 6-202 TO READ SO THAT  MEMBERSHIP OF THE ELECTRICAL BOARD WILL ASSURE THAT ONE OF THE LICENSED ELECTRICIANS SHALL ALSO HOLD A VALID AND ACTIVE ELECTRICAL INSPECTOR’S LICENSE

WITHIN THE STATE OF MARYLAND. (COMPOSITION OF THE BOARD WILL REMAIN THE SAME AS OUTLINE IN SECTION 6-202; 6 MASTERS, 3 PUBLIC MEMBERS.) 8. ADD A SECTION TO TITLE 6 THAT WILL  REQUIRE ALL ACTIVE MASTER ELECTRICIANS THAT ADVERTISE TO PROVIDE ELECTRICAL SERVICES TO DISPLAY THEIR STATE LICENSE AT THEIR PLACE OF BUSINESS AND TO ALSO DISPLAY THEIR STATE LICENSE NUMBER AND COMPANY NAME USED ON JOBSITE VEHICLES. (NO OTHER LICENSE NUMBERS WILL BE REQUIRED ON VEHICLES. CONTRACTORS CAN BE CONTROLLED BY THE STATE NUMBER.) 9. ADD A SECTION TO TITLE 6 THAT WILL  GIVE THE STATE BOARD THE AUTHORITY (IF LOCAL ENFORCEMENT OFFICIALS DO NOT HAVE THAT AUTHORITY) TO FINE OR DISCIPLINE UNLICENSED PERSONS OR WORK PERFORMED WITHOUT PROPER PERMITS. FINES WILL BE $1,000 FOR FIRST OFFENSE, $2,000 FOR SECOND OFFENSE AND $5,000 AND/OR JAIL SENTENCE NOT EXCEEDING 30 DAYS FOR THIRD OFFENSE AFTER AN ADMINISTRATIVE HEARING.

 ALL APPRENTICES WILL BE REQUIRED TO HOLD A STATE LICENSE AND BE SUPERVISED BY LICENSED ELECTRICIANS WHILE PROVIDING ELECTRICAL SERVICES. 10. ADD A SECTION THAT STATES  WITHOUT EXAMINATION, APPRENTICES WILL AUTOMATICALLY BE ISSUED A STATEWIDE LICENSE UPON APPLICATION TO DLLR AND NO OTHER LICENSE FEE OR REGISTRATION WILL BE ALLOWED OR REQUIRED THAN THE STATE FEE. 11. ADD A SECTION FOR THE REQUIRED QUALIFICATIONS TO BECOME A LICENSED JOURNEYPERSON A. AN APPLICANT FOR JOURNEYPERSON MUST PASS AN ACCREDITED JOURNEYPERSON EXAMINATION AFTER OBTAINING 4 YEARS OF WORKING EXPERIENCE AS A LICENSED APPRENTICE. (NOTE: ONE YEAR SHALL MEAN 2,000 HOURS); OR, B. WITHOUT ADDITIONAL EXAMINATION AND WITHIN ONE YEAR OF GRADUATION, PROVIDE A CERTIFICATE OF COMPLETION OF ELECTRICIAN APPRENTICESHIP PROGRAM FROM THEMARYLAND APPRENTICESHIP AND TRAINING COUNCIL OR THE FEDERAL COMMITTEE ON APPRENTICESHIP. (NOTE: THESE APPROVED PROGRAMS ARE BASED ON AT LEAST 576 HOURS OF CLASSROOM TRAINING AND 8,000 HOURS OF WORKING EXPERIENCE.)

  1. ADD A GRANDFATHERING SECTION SO THAT

ALL CURRENT APPLICANTS DO NOT LOSE POSITION, CLASSIFICATION OR STATUS IN THE TRADE AND SINCE ALL MASTERS AND JOURNEYPERSONS MUST BE LICENSED.  MASTERS – ANY MASTER ELECTRICIAN WHO CURRENTLY DOES NOT HOLD A STATE LICENSE CAN OBTAIN THAT STATE LICENSE WITHOUT EXAMINATION WHEN PROVIDING PROOF OF A VALID AND CURRENT JURISDICTIONAL MASTER LICENSE THAT IS NOT BEING DISCIPLINED, SUSPENDED OR REVOKED.  JOURNEYPERSON – ALLOW ALL APPLICANTS TO OBTAIN A STATEWIDE LICENSE WITHOUT ADDITIONAL EXAMINATION UNDER THE FOLLOWING CONDITIONS: A. ANY PERSON WHO HAS WORKED IN THE CLASSIFICATION OF JOURNEYPERSON FOR A MINIMUM OF 7 YEARS AND PROVIDES PROOF FROM AN ACTIVE LICENSED MASTER ELECTRICIAN. (NOTE: THIS PROVISION WILL REMAIN IN EFFECT ONLY UNTIL 7/1/2018.); OR, B. ANY PERSON THAT CURRENTLY HOLDS AN EXISTING CERTIFICATE OF COMPLETION OF ELECTRICIAN APPRENTICESHIP PROGRAM FROM THE MARYLAND APPRENTICESHIP AND TRAINING COUNCIL OR THE FEDERAL COMMITTEE ON APPRENTICESHIP BASED ON 576HOURS OF CLASSROOM TRAINING AND 8,000 HOURS OF WORKING EXPERIENCE. (NOTE: THIS PROVISION WILL REMAIN IN EFFECT ONLY UNTIL 7/1/2018.); OR, C. ANY PERSON MAY RECIPROCATE FOR A STATE LICENSE IF THEY PROVIDE PROOF OF AN EXISTING LICENSE ISSUED ONLY BY CALVERT, CHARLES, HARFORD, MONTGOMERY OR PRINCE GEORGE’S COUNTIES; OR, D. OTHERWISE, THE QUALIFICATIONS FOR A JOURNEYPERSON SHALL BE THAT AN APPLICANT SHALL HAVE 4 YEARS OF WORK EXPERIENCE AND PASS AN ACCREDITED JOURNEYPERSON EXAMINATION. 13. ADD A NEW SECTION THAT STATES  JOURNEYPERSONS HOLDING A VALID STATE LICENSE OR ONE ISSUED BY THE FOLLOWING FIVE COUNTIES: CALVERT, CHARLES, HARFORD, MONTGOMERY AND PRINCE GEORGE’S, WILL BE GIVEN THE AUTHORITY TO PERFORM ELECTRICAL SERVICES ANYWHERE IN THE STATE OF MARYLAND AND WILL NOT BE REQUIRED BY ANY MUNICIPALITY OR LOCAL JURISDICTION TO PAY ADDITIONAL LICENSING OR REGISTRATION FEES.  AN EXCEPTION TO THE STATE LICENSING REQUIREMENT SHALL BE THE FIVE COUNTIES THAT ALREADY ISSUE JOURNEYPERSON LICENSES: CALVERT, CHARLES, HARFORD, MONTGOMERY AND PRINCE GEORGE’S COUNTIES – THEY MAY CONTINUE IN THEIR PRESENT SYSTEM OF LICENSING JOURNEYPERSONS AND THE IDENTIFICATION CARDS THAT THEY ISSUE SHALL HAVE THE SAME AUTHORITY AS THE STATE ISSUED JOURNEYPERSONS LICENSE.

CLOSING THE PROPOSED CHANGES SHOULD NOT HAVE A GREAT FINANCIAL IMPACT ON THE INDUSTRY OR CITIZENS OF MARYLAND. A REASONABLE SEMI-ANNUAL FEE OF $10 FOR APPRENTICES AND $40 FOR JOURNEYPERSONS WILL CERTAINLY NOT BANKRUPT THE AFFECTED WORKERS OR THE GENERAL PUBLIC. THE FEES COLLECTED SHOULD ALSO PROVIDE ENOUGH REVENUE TO DLLR TO OFFSET THE EXPENSES OF LICENSING THOSE ADDITIONAL TRADE PERSONS.AN ADDITIONAL BENEFIT IS THAT ADMINITRATIVE OFFICIALS AND LOCALITIES MAY CONTINUE TO OPERATE WITH LICENSING, PERMIT PROCESSING AND ENFORCEMENT PROCEDURES WITHOUT ANY CHANGE OR COST TO THEM. THE PROPOSED CHANGES WILL NOT ONLY ENHANCE THE REGULATION AND CONTROL OF THE ELECTRICAL INDUSTRY, BUT HOPEFULLY ACHIEVE A BETTER LIVING AND WORKING STANDARD FOR ELECTRICAL WORKERS.THE INDUSTRY FEELS THAT THE PROPOSALS SHOULD BE IMPLEMENTED AS SOON AS POSSIBLE KNOWING THAT THE STATE ELECTRICAL BOARD WILL BE RE-EVALUATED IN 2020. THIS WILL ALLOW FOR A 4-YEAR TRIAL PERIOD AND IF FURTHER CHANGES ARE NEEDED, THEY CAN BE ADDRESSED AT THAT TIME.
